Terms and Condition of Use

The use of the Site is governed by the terms and conditions stated hereafter. You must read and accept these terms and conditions prior to accessing the Site. If you enter on the Site, you acknowledge having read, understood, and commit to adhering to them. The Operator reserves the right to change these terms and condition without prior notice. 1. Definitions
For the purposes of this Agreement, the following words, expressions and terms, whether they are used in the singular, plural, present or future form, according to the context, will have the following meaning unless indicated otherwise:
Item : includes all means of communication and a combination thereof, including but not limited to text, articles, statements, declarations, photographs, illustrations, images, graphics, music, songs, videos and video equipment;
Operator: means Oceanik Solutions Inc.;
Object of the copyright: includes all the architectural, artistic, choreographic, film, drama, literary and musical work within the meaning of the Copyright Act;
Site: www.oceanik.com;
User: The person visiting the site.
2. Terms of Use
2.1 The user who resides in a territory where local legislation prohibits access to the Site or its must comply. Failure to do so will result in the user being subject to the penalties and fines applicable in the law of the territory.
2.2 The user chooses to browse the Site undertakes to respecting and to complying with all applicable laws in the territory of the province of Quebec and, without limiting the generality of the foregoing statement, to respect the law on copyright and not contravene the Criminal Code. The user further recognizes that only Quebec courts are competent to hear and determine any dispute arising from the use of the Site.
2.3 The user acknowledges that they may not copy, reproduce, distribute, translate, download, display or transmit in any way an Object of copyright without first obtaining the written permission of the owner of the copyright.
2.4 The user acknowledges that all the elements that they make available to the public that that comply with the terms and conditions herein become the sole and exclusive property of the operator. The operator will be the sole owner of all intellectual property rights of these elements. As such, the operator may use, reproduce, display, compile and distribute these elements in any format, media or technology.
3. Trademarks
3.1 Logos and icons identifying the services of the Operator which are mentioned in the Site or elsewhere are registered trademarks of the latter. All other products, brands or company names mentioned here or on other web sites are trademarks of their respective owners. It is strictly forbidden for the User to use a trademark without the prior written permission of the trademark’s owner.
4. Links to other Sites
4.1 If the Site of the Operator contains links to other sites that are operated by other companies. By clicking on these links, the user leaves the site of the Operator. The Operator has no control over these sites and the fact that they are listed on the Site does not result in liability.
4.2 The Operator shall notify the User that all information or personal information that they transmit through these sites are governed by the policies of these companies. It is therefore recommended that the User review these policies before sending anything.
5. Internet Transactions
5.1 Any purchase or transaction made through the Internet or the Site requires the User to provide personal information, their credit card number or other payment information. The user guarantees that any information provided to a merchant or other supplier through the Site will be accurate and complete. They agree to pay all costs incurred at be the price in effect and at the time where they have been incurred. They will also be required to pay, where applicable, all applicable taxes on purchases made through the site.
5.2 The Operator assumes no responsibility for personal information transmitted on the Internet or for the costs incurred by the user in such purchases or transactions via the use of the Site.
6. Personal Information
6.1 All personal information that you transmit directly to the Operator through the Site are subject to the Information Privacy Code of the Operator. For more information, see pthe section on Private Life.
7. Security Measures
7.1 The operator has set security measures on its web site that are at the leading edge of technology in order to protect the user against loss or unauthorized use of their information. The Operator's servers are protected by firewall technology. However, no security measure is perfect and the User must be aware that there is a risk that the personal information they send may be disclosed through no fault of the Operator.
7.2 The User expressly acknowledges that the Operator cannot ensure or warranty the security and confidentiality of information circulating on the Internet. That is why the User has the full responsibility to take security measures required to protect the data they choose to send to the site, particularly in regard to the DAMAGE RESULTING FROM COMPUTER VIRUS, THE CONTENT, USE, OR THE VALIDITY OF THE QUALITY OF SERVICES PROVIDED THROUGH THE SITE OR THE INTERNET, LOSS OR DESTRUCTION OF DATA BY INTRUSION OR OTHERWISE, OR FOR THE UNAUTHORIZED INTERCEPTION OF COMMUNICATIONS.
7.3 The User declares that he expressly waives any demand, claim or suit against the Operator that could result from the use of the Site or the Internet service.
8. Warranties and Responsibilities
8.1 The Operator assumes no responsibility for the accuracy or validity of all elements that are replicated or appear on its Site. These items are provided without any warranty. The Operator must not, under any circumstances, be liable for any damages whatsoever relating to the use or application of the elements available on the Internet or its Web site
8.2 The Operator is not responsible for the use of the Internet or the Site that would violate the Copyright Law, the Criminal Code and other applicable laws. The User further agrees not to hold the Operator responsible from any demand, claim or action relating to this Article
8.3 The Operator does not guarantee the uninterrupted functioning of Internet service and the Site and assumes no liability to User for damages resulting from omissions, interruptions, delays, errors in transmission, transmission of data loss defects, defects of equipment or any other malfunctions of the Internet service or the Site. In the case of a such event, the User will not hold the Operator responsible for any claim in damages and interest direct, indirect, or special, arising from the use of the Internet service and the Site.
9. Cookie
9.1 A cookie is a very small text file which is incorporated into your hard drive from certain pages of the Web Site. Cookies are harmless because they cannot retrieve information from your hard disk on which you have full control. The Operator uses cookies in order to determine traffic on the site, to transmit information that is highly usable by its marketing department, and to personalize your use of the Site. 10. Amendment
10.1 LThe Operator reserves the right to change, without notice, the terms and conditions of this agreement. These amendments are binding on the User as soon as they are published on the Site. The User declares that he agrees to abide by them.
11. Warning
11.1 The User that now decides to go to the website of the operator acknowledges that he is aware of all the terms and conditions mentioned above, understands, accepts them, and undertakes to respect them in their entirety.
